Enovie is a Child Care and Community Education Software platform operated by Bruber Financial Services, Inc. (“Enovie,” “we,” “us,” or “our”). This Privacy Policy (the “Policy”) explains the types of personal information we collect when you visit our website at enovie.com (the, “Site”), use the Enovie platform (the “Services”), communicate with us, or otherwise provide us with personal information online or offline. This Policy also explains how we use your personal information, who we may disclose it to, and certain rights and options you may have regarding your personal information.

### 1. Who Uses Our Services

The Enovie platform is used by schools, districts, educational organizations, child care providers, and their authorized personnel (collectively, our “customers”). Students do not directly access our platform or use our Services. Our customers, however, may store or process information about students within the Services as part of their use of the platform.

When a school or other customer provides student information to us, we process that information to provide the Services to the customer and according to our agreement and the customer’s instructions. The school or other customer remains solely responsible for determining what student information is stored or processed using the Services and for meeting its own legal obligations with respect to that information.

### 2. Personal Information We Collect or Receive

For purposes of this Policy, “personal information” is any information that identifies, relates to, or can reasonably be used to contact or identify a particular individual. The personal information we collect depends on how you interact with us and may include the categories described below.

**A. Account Registration Information**

When a parent, guardian, customer administrator, or other authorized user creates an account to access the Services, we collect account registration information, including:

- Your first and last name, email address, telephone number (including mobile number), and mailing address;
- Your username, password, and other login credentials; and
- the school, district, child care provider, or other customer you are associated with, and your role (for example, parent or guardian, or customer staff or administrator).

**B. Information Provided Through Your Account**

Once your account is set up, you may use the Services to register a child for before- and after-school care, extracurricular activities, enrichment courses, or other programs offered by a customer, and to manage that participation. Depending on the program and the information requested by the customer, the information provided through your account may include:

- **Participant information**: the child’s name, date of birth, grade, school, gender, race or ethnicity, and address;
- **Contact and safety information**: emergency contacts, authorized pick-up persons, and custody or related instructions;
- **Health and support information**: allergy, medical, dietary, or medication information, and information about special needs, accommodations, or other concerns;
- **Program information**: enrollment, scheduling, attendance, and related program records;
- **Responses to customer questions**: answers to questions or forms created by the customer; and
- **Transaction information**: details about payments made through the Services, such as the amount, date, program, and payment status. Payments are processed by our third-party payment processors. We do not store your full payment card number or other restricted cardholder data.
- **Communication preferences**: how a user would like to receive communications from us, including whether a user has opted in to receive text messages.

Please note, however, that each school, district, child care provider, or other customer is responsible for deciding what information is required to register for its programs, including which fields are required and which are optional. If you have questions about why a customer requests certain information, please contact that customer. We treat any information provided through an account in connection with a customer’s programs as data belonging to that customer (“Customer Data”). We store and process Customer Data on behalf of the customer to provide the Services, and we do not use it for any other purpose, except as described in Section 4 or as required by law.

As a parent or guardian, you decide what optional information to provide about yourself and your child, and you are responsible for making sure that the information you provide is accurate and that you have the right to provide it.

**D. Website Visitors and Prospective Customers**

When you visit our Site, request a demo or information, or otherwise contact us, we may collect your name, email address, telephone number, organization and title, the content of your communications, and your marketing preferences.

**E. Automatically Collected Information**

When you visit our Site or use the Services, we and our service providers may automatically collect information about your device and how you interact with us, such as your IP address, browser and device type, pages viewed, referring pages, dates and times of access, login and security records, and diagnostic information. We collect this information using cookies, log files, pixels, and similar technologies, as described in Section 6.

**F. Information from Other Sources**

We may receive information from (for example, when a customer sets up accounts or uploads program information), from payment processors (for example, confirmation that a payment was completed), and from integrations or other services that a customer elects to connect to the Services.

### 3. How We Use Personal Information

We (or service providers acting on our behalf) may use the personal information identified above to:

- Provide, operate, maintain, and secure the Site or Services, including enabling customers to manage registration, scheduling, payments, attendance, and communications;
- Create and administer accounts for customers and authorized users;
- Facilitate payments through our third-party payment processors;

- Comply with law, enforce our agreements, and protect the rights, safety, and property of our customers, users, Enovie, and others; and
- Perform other functions described to you at the time of collection or to which you consent.
- **Customers**. Information you provide through your account in connection with a customer’s program is available to that customer and its authorized personnel.
- **Service providers**. Vendors that help us host, secure, maintain, support, and operate the Site and Services and otherwise support our business, including cloud hosting, IT administration, messaging, and customer support providers.
- **Payment processors**. Third-party vendors that process payments made through the Services.
- **Customer-selected integrations**. Third parties that a customer elects to connect to the Services, such as state attendance or reporting systems, when the customer authorizes or directs the connection.

- **With Consent**. Other parties when you or the applicable customer directs us to do so or consents.

We use Customer Data only to provide and support the Services for the applicable customer, as directed by that customer, or as required by law. We do not use Customer Data, including student information, for marketing or advertising, and we do not sell such information.

### 4. Student Information and FERPA

Because our customers may place student information in the Services, we treat that information as Customer Data controlled by the customer. We access, use, disclose, and retain student information only as necessary to provide and protect the Services, as directed by the customer, as permitted by our agreement with that customer, or as required by law.

The Family Educational Rights and Privacy Act (“FERPA”) is a federal law that protects personally identifiable information in students’ education records. FERPA gives parents certain rights with respect to their child's education records, including the right to access the records, to request that the records be amended, and to have some control over the disclosure of personally identifiable information from the records. FERPA applies to certain schools and school officials. Accordingly, we will work with school customers to support their compliance with FERPA and other student privacy laws, as applicable.

If you are a parent or guardian and would like to access, review, or request changes to your child’s records, please contact your child’s school, district, or program provider directly. We will assist our customers in responding to those requests as required by our agreements with them.

### 6. Cookies and Analytics

Our Site and Services use various technologies for security, functionality, remembering preferences, analytics, and to collect information about users. For example, on the Site, we may use third-party tools to understand website traffic and manage outreach to prospective customers. These vendors may collect information about your use of the Site directly and may receive that information at the same time we do.

The technologies we use on our Site and Service include:

- **Pixels, tags, web beacons, gifs, and similar technologies.** These technologies are small pieces of code that run when a website page is loaded. They are used to monitor the behavior of the visitor—such as what icons were clicked—and gather analytics and details about the interaction. For example, when you open our homepage, a pixel may run and generate information based on the visit (e.g., your IP address and what day and time you were on the homepage), and then this information is processed by us or our vendors. Pixels and tags work in conjunction with cookies to let us know what portions of our Site are of interest to you and to help us provide you with tailored information. Even if you have disabled or turned off cookies (discussed below), the pixels, tags, and web beacons we use may still detect and collect certain information about your interaction with our websites; in other words, these kinds of technologies may disregard any cookie-prohibitive markers or signals.
- **Cookies**: Cookies are small text files that can be used by websites to make a user’s experience more efficient. Our website uses different types of cookies to, among other things, automatically recognize you when you return to our site, power customer service interactions, determine our marketing effectiveness, store information regarding your profile, preferences, and interests, and analyze traffic to our site. Please note that where cookies are essential to the operation of our site, if disabled, you may not be able to enjoy certain features of the site. For further information about cookies, including how to refuse cookies, please visit [www.allaboutcookies.org](http://www.allaboutcookies.org/). ***We do not honor “Do Not Track” signals.***
- **Log Files and Device Identifiers**. We use log files to track actions occurring on our digital properties and to collect data about visitors and identify returning customers, including IP address, browser type, Internet service provider, referring/exit pages, visited pages and accompanying tags, date/time stamps, and device identifiers.
- **Analytics.** Our digital properties may also deploy third-party analytics tools, such as Google Analytics. You can find more information about how data is collected and processed in connection with the Google Analytics service at [https://policies.google.com/technologies/partner-sites](https://policies.google.com/technologies/partner-sites). You can also read Google’s privacy policy at [https://policies.google.com/privacy?hl=en](https://policies.google.com/privacy?hl=en).

These technologies may be set or controlled by use (first-party technologies) or they may be set or controlled by third-party vendors or partners (third-party technologies). Further, these technologies can be categorized as follows.

- **Essential:** These technologies are necessary for the website to function and cannot be switched off in our systems. Examples include: cookies that allow pages to load correctly and technologies used to power our chat services.
- **Performance:** These technologies allow us to count visits and traffic sources so we can measure and improve the performance of website and mobiles application. They help us to know which pages are the most and least popular and see how visitors interact with and move around the digital properties. Examples include: technologies we use for analytics.
- **Functional:** These technologies are not strictly necessary for the website to function but help us improve your experience and understand your interests and how our site is used. Examples include: cookies and pixels that analyze your browser settings and preferences, tagging webpages based on interest.
- **Advertising:** The Site may use technologies that support features like embedded videos or social media sharing. These technologies may collect personal information and may track your activity across other websites.

The information collected through these technologies may be combined with personal information or aggregated with other information on website visits. We may share information about your use of our website with our analytics partners. Please note, we do not use any pixels, tags, web beacons, gifs, tracking cookies, and similar technologies within our customer admin or community portal applications.

**What We Send:** The text messages we send include, for example, emergency notifications, closures, reminders, attendance-related communications, schedule changes, registration and payment confirmations, and other informational program updates.

**Message Frequency:** Message frequency varies based on your enrollment activity and communications from your program provider.

**Message and Data Rates:** Message and data rates may apply. Contact your wireless carrier for information about your plan.

**Sharing:** Mobile phone numbers, SMS opt-in data, and consent records are not sold and are not shared with third parties or affiliates for marketing or promotional purposes. We share this information only with service providers that help us deliver text messages, such as messaging platform and telecommunications providers. The categories of disclosure described elsewhere in this Policy exclude text messaging originator opt-in data and consent, which will not be shared with any third party except as necessary to provide the messaging services.

**Retention:** We retain your mobile phone number and consent records for as long as your account is active, as needed to provide the Services, or as required by law.

### 8. Data Security and Retention

We use reasonable administrative, technical, and physical safeguards designed to protect personal information from loss, theft, and unauthorized access, use, disclosure, or modification. No system or transmission over the internet, however, is completely secure, and we cannot guarantee the security of any information.

We retain personal information only for as long as reasonably necessary to provide the Services, meet contractual and legal obligations, resolve disputes, and maintain security. Customer Data, including student information, is retained and deleted in accordance with our agreements with customers and applicable law.

- **Account information**. You may review and update your account information through your account profile.
- **Tracking technologies**. Depending on your browser or device, you may have the option to set the browser to accept all cookies, reject all cookies, notify you when a cookie is set, or delete cookies. Each browser and device are different, so we recommend you evaluate the tools and settings available in your browser or device, as well as any available instructions for the same. The National Advertising Initiative also makes resources available to assist consumers in opting out of certain online advertisements, which you can access at [https://optout.networkadvertising.org/?c=1](https://optout.networkadvertising.org/?c=1).

### 10. Requests Involving Student Information

To submit a request relating to student information under FERPA or other applicable law, please contact your student’s school, school district, or program provider. ### 11. Children’s Privacy

The Services are not directed to children, and children, including those under the age of 13, do not create accounts, log in, or directly provide information to us through the Services. Parents, guardians, and authorized customer personnel may provide information about children through the Services in connection with a customer’s programs. We process that information on the customer’s behalf as described in this Policy. Parents and guardians with questions about their child’s information should contact the applicable customer or contact us using the information below. If we learn that a child has provided personal information to us directly, we will delete it.

### 12. Third-Party Websites and Services

The Site and Services may contain links to, or integrate with, third-party websites and services, including payment processors and customer-selected integrations. These third parties have their own privacy policies, and we are not responsible for their practices. We encourage you to review their privacy policies.

### 13. Changes to This Policy

We may update this Policy from time to time. We will post the updated Policy and change the “Last updated” date above.
